1. Services
MetroWest Digital provides marketing automation services — including automated SMS review request systems — to local service businesses. Specific services and deliverables are agreed upon between MetroWest Digital and each client prior to the start of service.
2. SMS Messaging Terms
Description of SMS Use: MetroWest Digital sends automated SMS text messages on behalf of local businesses to their customers. Message types include: Google review requests sent after service completion, follow-up satisfaction messages, and related communications.
Consent Is Not a Condition of Purchase: Providing a phone number and consenting to receive SMS messages is entirely optional and is never required in order to purchase or receive services from our client businesses.
Opt-Out Instructions: Recipients may opt out of all SMS messages at any time by replying STOP to any message. Upon opting out, one final confirmation message will be sent, and no further messages will be delivered. To re-subscribe, reply START.
Message and Data Rates: Standard message and data rates may apply. Message frequency may vary. Contact your mobile carrier for details about your plan.
Age Restriction: Our SMS services are intended for individuals who are 18 years of age or older. By providing a phone number and consenting to receive messages, you confirm that you are at least 18 years old.
Carrier Liability: MetroWest Digital and participating wireless carriers are not liable for delayed or undelivered messages. Carrier message delivery is not guaranteed and may be affected by factors outside our control, including network availability and carrier policies.

3. Client Responsibilities
By using our SMS services, clients agree to:
- Only provide contact information for customers who have given consent to receive SMS communications
- Comply with all applicable laws, including the Telephone Consumer Protection Act (TCPA)
- Not use our services for spam, harassment, or any unlawful purpose
- Ensure all customer opt-in processes meet legal requirements
4. Payment Terms
Services are billed on a monthly recurring basis unless otherwise agreed. The first month of service may be provided free of charge as a trial period. After the trial period, billing begins at the agreed monthly rate. Clients may cancel at any time with no long-term commitment required.
5. No Guarantee of Results
While we strive to deliver meaningful results, MetroWest Digital does not guarantee specific outcomes such as a minimum number of reviews, improvement in star ratings, or increases in revenue. Results vary based on factors outside our control.
6. Intellectual Property
Websites and digital assets built by MetroWest Digital for clients become the property of the client upon full payment. Our internal systems, workflows, and automation tools remain the property of MetroWest Digital.
7. Limitation of Liability and Carrier Disclaimer
MetroWest Digital shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services, including any damages arising from delayed, undelivered, or misdirected SMS messages. Mobile carriers are not liable for any messages sent through our platform. Our total liability shall not exceed the amount paid by the client in the most recent billing period.
8. Termination
Either party may terminate services at any time. Upon termination, access to MetroWest Digital systems will be discontinued. Clients retain ownership of their website and any data provided to us.
9. Privacy Policy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices, including how phone numbers are collected and how you can opt out of SMS communications.
10. Changes to Terms
We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the updated terms.
